SOURCE EXPLAINER

Child marriage: consent does not remove the statutory prohibition

RA 11596 addresses child marriage, prohibited conduct and the protection of children.

Verification basis

The cited official text was checked for the provisions or ruling discussed here. This is a focused source reading, not a certification that no later development affects the subject.

What happened

RA 11596 prohibits child marriage and penalizes specified conduct connected with it. The best interests of the child guide interpretation of the Act.

What the law/case says

Section 3 defines child and child marriage, including the forms of union specified in the statute. Section 4 separately addresses facilitation, solemnization and adult cohabitation with a child outside wedlock. Section 6 declares child marriage void from the beginning and refers support, property and custody questions to the relevant Family Code provisions.

Why it matters

Consent, custom or an informal description of the relationship does not by itself settle the statutory questions. The ages, conduct and legal status must be considered carefully.

Practical takeaway

Where a child’s safety or a proposed union is at issue, obtain appropriate legal and child-protection assistance promptly. Preserve relevant records without publicizing the child’s identity. This note does not determine criminal liability, custody or the procedure for a particular case.

Official source/citation

Read the definitions and prohibited acts together. The linked implementing rules supply further context; a short explanation should not replace a safeguarding assessment.
